Access to the Website implies knowledge and acceptance of these Terms, as well as being of legal age and being in full mental capacity to purchase any of the products available on the Website.

Access and Registration

The User guarantees that all identity data voluntarily provided when accessing NB Performance through its forms are truthful, accurate, and complete. If the User provides any false, inaccurate or incomplete data, or if NB Performance has reasonable grounds to doubt their truthfulness, accuracy, or completeness, NB Performance may deny present or future access to and use of the Website or any of its content and/or services.

User Obligations

In general, the User agrees to:

NB Performance will verify such reports as soon as possible and will take any measures it deems appropriate, reserving the right to remove and/or suspend any User of the Website for non-compliance with these Terms. NB Performance also reserves the right to remove and/or suspend any message with illegal or offensive content without prior notice or subsequent notification.

NB Performance’s Liability

NB Performance excludes any liability for damages of any kind that may result from unlawful use of the Website by Users or from the lack of truthfulness, validity, completeness, and/or authenticity of the information Users provide to other Users about themselves and, in particular but not exclusively, for damages of any kind that may result from a User’s impersonation of a third party in any communication made through the Website.

Without prejudice to the above, NB Performance reserves the right to limit, in whole or in part, access to the Website for certain Users, as well as to cancel, suspend, block, or remove certain types of content using appropriate technological tools if it becomes aware that the stored activity or information is illegal or infringes the rights or property of third parties. NB Performance is not responsible for security errors that may occur nor for any damage that may be caused to the User’s computer system (hardware and software), files, or documents stored therein, as a consequence of:

A malfunction of the browser; or the use of outdated versions thereof.

Website Update and Modification

NB Performance may amend these Terms at any time by email or by publishing the modified terms on the Website. All modified terms will automatically take effect 30 days after being published.

Likewise, NB Performance reserves the right, at any time and without prior notice, to update, modify, or delete information contained on its Website, as well as to change its configuration and presentation and the access conditions, without assuming any liability for doing so.

For the purposes of Organic Law 15/1999 of 13 December on the Protection of Personal Data, the personal data of users who register on the Website are protected under Organic Law 15/1999 (LOPD) and other related data protection regulations.

The User may exercise their rights of access, rectification, cancellation, and opposition by sending a written and signed request including name, surname(s), a photocopy of their ID, the specific request, and an address for notifications. Applicable Law

These Terms shall be governed by Spanish law, which shall apply to matters not provided for herein regarding interpretation, validity, and enforcement. Both parties submit, expressly waiving any other jurisdiction, to the Courts of Murcia.

The European Commission has made available to consumers in the European Union the Online Dispute Resolution (ODR) platform to amicably resolve disputes arising from e-commerce (Article 14(1) of Regulation (EU) 524/2013).
